TERMS AND CONDITIONS OF THE ZIGZAC WORKSHOP STORE<\/h1>\n\n\n\n

\u00a71. General provisions<\/h2>\n\n\n\n

  1. The online store Zigzac Workshop, operating at https:\/\/zigzacworkshop.com<\/a>, is run by:<\/li>\n<\/ol>\n\n\n\n

    hereinafter referred to as the \u201eSeller\u201d.<\/p>\n\n\n\n

    1. These Terms and Conditions set out the rules for using the Store, placing and executing orders, making payments, delivering Goods, handling complaints, withdrawing from the contract, and the rules of the Seller's liability.<\/li>\n\n\n\n
    2. The shop sells Goods via the Internet.<\/li>\n\n\n\n
    3. Information about the Goods presented in the Store constitutes an invitation to conclude an agreement within the meaning of the relevant legal provisions, and not an offer within the meaning of the Civil Code.<\/li>\n\n\n\n
    4. The seller makes sales to both consumers and businesses.<\/li>\n\n\n\n
    5. The provisions of Polish law, in particular the Civil Code and the Act on Consumer Rights, shall apply to agreements concluded via the Store.<\/li>\n<\/ol>\n\n\n\n

      \u00a7 2. Definitions<\/h2>\n\n\n\n

      1. Shop<\/strong> \u2013 the Zigzac Workshop online shop available at https:\/\/zigzacworkshop.com<\/a>.<\/li>\n\n\n\n
      2. Salesman<\/strong> \u2013 the entity specified in \u00a71 para. 1.<\/li>\n\n\n\n
      3. Customer<\/strong> \u2013 a natural person, legal person or organisational unit making a purchase in the Store.<\/li>\n\n\n\n
      4. Consumer<\/strong> \u2013 a natural person entering into a legal transaction with the Seller that is not directly related to their business or professional activity.<\/li>\n\n\n\n
      5. Sole trader with consumer rights<\/strong> \u2013 a natural person concluding a contract directly related to their business activity, where it is evident from the content of the contract that it does not have a professional character for them.<\/li>\n\n\n\n
      6. Goods<\/strong> \u2013 product offered in the Shop.<\/li>\n\n\n\n
      7. Order<\/strong> \u2013 the Customer's declaration of intent to conclude a contract of sale for the Goods.<\/li>\n\n\n\n
      8. Contract<\/strong> \u2013 a Goods sale agreement concluded between the Customer and the Seller via the Store.<\/li>\n<\/ol>\n\n\n\n
        \n\n\n\n

        \u00a73. Technical requirements<\/h2>\n\n\n\n
          \n
        1. To use the Store, you need:\n
            \n
          • internet-connected device,<\/li>\n\n\n\n
          • current web browser,<\/li>\n\n\n\n
          • active email address,<\/li>\n\n\n\n
          • when placing an order \u2013 enabled cookies and JavaScript support, if required for the proper functioning of the Store.<\/li>\n<\/ul>\n<\/li>\n\n\n\n
          • The Seller takes action to ensure the proper functioning of the Store.<\/li>\n\n\n\n
          • The Seller shall not be liable for technical problems arising from causes beyond the Seller's control, in particular those related to the Customer's device, software, or Internet access.<\/li>\n<\/ol>\n\n\n\n
            \n\n\n\n

            \u00a74. Goods and prices<\/h2>\n\n\n\n
              \n
            1. Information regarding the Goods, including their description, parameters, available variants and price, can be found on the individual Goods pages.<\/li>\n\n\n\n
            2. All prices given in the Store are gross prices and include VAT, unless stated otherwise for a given Product.<\/li>\n\n\n\n
            3. The price of the Goods does not include delivery costs, unless otherwise stated with regard to the Goods or during the order placement process.<\/li>\n\n\n\n
            4. The delivery cost is presented to the Customer before placing the Order.<\/li>\n\n\n\n
            5. The Seller may run promotions, sales and apply individual prices. The terms of the promotion are determined each time in the Store.<\/li>\n\n\n\n
            6. Promotions cannot be combined with one another, unless the terms and conditions of a given promotion state otherwise.<\/li>\n\n\n\n
            7. In the case of Goods made or prepared to the Customer's individual specification, the scope of such specification and the price shall be determined in the Order or individual arrangements on each occasion.<\/li>\n<\/ol>\n\n\n\n
              \n\n\n\n

              \u00a75. Placing Orders<\/h2>\n\n\n\n
                \n
              1. Orders can be placed via the Store 24 hours a day, 7 days a week, subject to maintenance breaks.<\/li>\n\n\n\n
              2. In order to place an Order, the Customer:\n
                  \n
                1. selects the Product and its variant, if available,<\/li>\n\n\n\n

                3. goes to the Order form,<\/li>\n\n\n\n
                4. provides the data necessary to complete the Order,<\/li>\n\n\n\n

                6. accept documents<\/li>\n\n\n\n
                7. confirms the obligation to pay,<\/li>\n\n\n\n
                8. makes a payment if the selected payment method requires it when placing the Order.<\/li>\n<\/ol>\n<\/li>\n\n\n\n
                9. Before placing the Order, the Customer receives information about the total price of the Goods, delivery costs and other costs, if any.<\/li>\n\n\n\n
                10. Placing an Order by the Customer constitutes an offer to conclude a sales contract for the Goods.<\/li>\n\n\n\n
                11. After placing the Order, the Seller sends the Customer a confirmation of its receipt to the e-mail address provided.<\/li>\n\n\n\n
                12. The sales contract is concluded upon confirmation of acceptance of the Order for execution by the Seller.<\/li>\n\n\n\n
                13. The Customer may receive information regarding the status of the Order to the e-mail address provided.<\/li>\n<\/ol>\n\n\n\n
                  \n\n\n\n

                  \u00a76. Payments<\/h2>\n\n\n\n

                  1. The Customer may pay for the Order using the payment methods available in the Store.<\/li>\n\n\n\n
                  2. Dost\u0119pne metody p\u0142atno\u015bci s\u0105 prezentowane Klientowi podczas sk\u0142adania Zam\u00f3wienia.<\/li>\n\n\n\n
                  3. If payment is not made within the time limit specified in the chosen payment method, the Seller may cancel the Order after having unsuccessfully requested the Customer to make payment, if required.<\/li>\n\n\n\n
                  4. Electronic payments may be handled by external payment operators indicated in the Store.<\/li>\n\n\n\n
                  5. The seller issues a sales document in accordance with applicable law.<\/li>\n\n\n\n

                    –w zakresie p\u0142atno\u015bci obs\u0142ugiwanych przez system WooPayments (WooCommerce Payments):<\/strong> serwis realizowany jest przez Stripe Payments Europe, Limited (SPEL) z siedzib\u0105 w Irlandii (1 Grand Canal Street Lower, Grand Canal Dock, Dublin).<\/li>\n<\/ol>\n\n\n\n
                    \n\n\n\n

                    Delivery<\/h2>\n\n\n\n
                      \n
                    1. The Goods are delivered to the address indicated by the Customer when placing the Order or to the selected collection point\/automatic delivery machine, if the given delivery method is available.<\/li>\n\n\n\n
                    2. Available delivery methods and their prices are presented when placing the Order.<\/li>\n\n\n\n
                    3. Termin realizacji Zam\u00f3wienia jest wskazany podczas sk\u0142adania Zam\u00f3wienia. Zwykle wynosi do 3 dni roboczych w przypadku produkt\u00f3w standardowych oraz do 10 dni w przypadku produkt\u00f3w personalizowanych.
                      Dok\u0142adamy wszelkich stara\u0144 by zam\u00f3wienia realizowane by\u0142y niezw\u0142ocznie.<\/li>\n\n\n\n
                    4. W przypadku Towar\u00f3w wykonywanych na zam\u00f3wienie termin realizacji mo\u017ce by\u0107 d\u0142u\u017cszy ni\u017c w przypadku Towar\u00f3w dost\u0119pnych od r\u0119ki. <\/li>\n\n\n\n
                    5. If the Order includes Goods with different delivery times, the Seller may send the Order in parts if this has been agreed with the Customer or results from the available delivery methods.<\/li>\n\n\n\n
                    6. The risk of accidental loss or damage to the Goods passes to the Consumer upon delivery of the Goods to the Consumer.<\/li>\n<\/ol>\n\n\n\n
                      \n\n\n\n

                      \u00a78. Right of withdrawal<\/h2>\n\n\n\n
                        \n
                      1. A consumer and an entrepreneur with consumer rights who has concluded a distance contract may, in principle, withdraw from the contract within 14 days without giving any reason.<\/li>\n\n\n\n
                      2. The period for withdrawal from the contract generally starts from the day on which the Consumer or a person indicated by him other than the carrier comes into possession of the Goods.<\/li>\n\n\n\n
                      3. In order to exercise the right of withdrawal, the Customer should inform the Seller of his\/her decision before the deadline expires by submitting an unequivocal statement, e.g. electronically to the Seller's e-mail address.<\/li>\n\n\n\n
                      4. The Customer may use the withdrawal form attached to these Regulations, but this is not obligatory.<\/li>\n\n\n\n
                      5. In the event of effective withdrawal from the contract, the Seller shall refund to the Customer all payments received, including the cost of the cheapest standard delivery method offered by the Store.<\/li>\n\n\n\n
                      6. The Seller shall refund the payment immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract.<\/li>\n\n\n\n
                      7. The Seller may withhold reimbursement until the Goods are received back or the Customer provides proof of sending them back, whichever occurs first.<\/li>\n\n\n\n
                      8. The Customer should return the Goods immediately, no later than 14 days from the date of withdrawal from the contract.<\/li>\n\n\n\n
                      9. The direct cost of returning the Goods shall be borne by the Customer, unless the Seller has agreed to bear this cost or the obligation to bear it results from legal provisions.<\/li>\n\n\n\n
                      10. The Customer is liable for any reduction in the value of the Goods resulting from their use in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.<\/li>\n\n\n\n
                      11. The right to withdraw from the contract does not apply in cases specified in legal provisions, in particular in relation to non-prefabricated Goods, manufactured according to the Consumer's specifications or intended to meet his individual needs.<\/li>\n<\/ol>\n\n\n\n
                        \n\n\n\n

                        \u00a79. Reklamacje i niezgodno\u015b\u0107 Towaru z umow\u0105<\/h2>\n\n\n\n

                        1. Sprzedawca ponosi wobec Konsumenta odpowiedzialno\u015b\u0107 za zgodno\u015b\u0107 Towaru z umow\u0105 na zasadach okre\u015blonych w obowi\u0105zuj\u0105cych przepisach prawa.<\/li>\n\n\n\n
                        2. Je\u017celi Towar jest niezgodny z umow\u0105, Konsument mo\u017ce skorzysta\u0107 z uprawnie\u0144 przewidzianych w ustawie o prawach konsumenta.<\/li>\n\n\n\n

                            • Sprzedawca rozpatruje reklamacj\u0119 w terminie wymaganym przez obowi\u0105zuj\u0105ce przepisy prawa.<\/li>\n\n\n\n
                            • W przypadku uznania reklamacji Sprzedawca ponosi koszty przewidziane przepisami prawa, w szczeg\u00f3lno\u015bci koszty naprawy, wymiany lub transportu Towaru.<\/li>\n\n\n\n
                            • Konsument nie jest zobowi\u0105zany do posiadania paragonu fiskalnego jako jedynego dowodu zakupu.<\/li>\n\n\n\n

                              \u00a710. Reklamacje przedsi\u0119biorc\u00f3w<\/h2>\n\n\n\n

                              1. W przypadku Klient\u00f3w nieb\u0119d\u0105cych Konsumentami ani przedsi\u0119biorcami na prawach konsumenta odpowiedzialno\u015b\u0107 Sprzedawcy jest okre\u015blona zgodnie z przepisami prawa oraz warunkami zawartej umowy.<\/li>\n\n\n\n
                              2. Postanowienia niniejszego Regulaminu nie maj\u0105 na celu ograniczenia praw przyznanych Konsumentom lub przedsi\u0119biorcom na prawach konsumenta na podstawie bezwzgl\u0119dnie obowi\u0105zuj\u0105cych przepis\u00f3w prawa.<\/li>\n<\/ol>\n\n\n\n
